Supreme Court Dissolves All Proceedings in Medical Admissions Case at Calcutta High Court
News from the source of Reader Wall shows that the Chief Justice of India, D.Y. Chandrachud, along with four other judges, held a special session on Saturday. They decreed a stay on all ongoing proceedings in a notorious medical admissions case at the Calcutta High Court which had resulted in a highly publicized conflict between two of the Calcutta High Court judges.
Suspension of Justice Gangopadhyay’s Orders
In addition to halting the proceedings, the Supreme Court has also put on hold the directives of Justice Abhijit Gangopadhyay, including his call for transferring the high-profile case to the Central Bureau of Investigation (CBI).
Acknowledging Responses from West Bengal Government and the Centre
Notices have been served by the bench to the West Bengal government, the CBI, and the person who initially filed the petition in the High Court. Simultaneously, the State Government has been given permission to individually file a special leave petition against the orders given by Justice Gangopadhyay later in the day.
In response, the Centre has been permitted to disseminate a note. The Attorney General, R. Venkataramani, as well as the Solicitor General, Tushar Mehta, have challenged the process upheld by the Division Bench of the High Court, which stay Justice Gangopadhyay’s orders without even going over the copies of his judicial order, case records or the appeal document.
Future Proceedings Defined
The five-judge bench from the Apex Court has recommended that both the State government and the Centre should not attempt to pass any prima facie remarks on the case. The case has been scheduled for a hearing on January 29.
